Terms of service

1 General
1.1 References to “We”, “Us”, “Our”, and “The company” means Bluebell Mobility Ltd.
1.2 The company are under a legal duty to supply goods that are in conformity with the contract of sale.
1.3 All quotations are made and all orders are accepted by the Company subject to the following conditions.
1.4 Quotes shall remain open for a maximum period of 30 days from the date of estimate and may be withdrawn by the Company within such period at any time by written or oral notice.
1.5 These Terms and Conditions and any separate agreements whereby the company provides you goods and/or services shall be governed by and construed in accordance with the laws of United Kingdom.
2 Pricing and VAT
2.1 All prices quoted are in Great British pounds sterling, and will clearly state whether they include relief from VAT.
2.2 If any alteration to the goods ordered is requested by the Customer and agreed by the Company an appropriate adjustment in the price for the goods may be made by the Company.
2.3 Certain goods supplied may be eligible for relief from VAT if the goods being supplied are for individual disabled persons for use in their day-to-day life. Business purchases are not eligible to claim VAT relief. VAT may be charged in the event of a change in the law. The Company will require a signed declaration of eligibility for VAT relief.
2.4 For any bespoke product being ordered, the company will start incurring costs when your order begins processing. As such, the company will require a deposit (or payment in full) when you place a bespoke order. Should you decide to cancel a bespoke order then the company will be entitled to keep some or all of the deposit to pay for any costs incurred.
2.5 Ownership of the goods supplied shall only pass to the customer when the customer has paid to the company all sums due under the order. The balance will be payable once the customer has been notified that the goods are available for collection, or immediately prior to delivery or installation of the goods. Failure to pay the balance at this time may result in the goods being withheld until the balance is paid.
3 Delivery
3.1 The Company will endeavour to deliver the goods as arranged with the Customer within a reasonable time and delivery dates are given as accurately as possible but cannot be guaranteed. Typically, the company delivers standard items within 1-2 weeks and deliver/install bespoke items within 2-6 weeks but will keep you fully informed. Unless time is made of the essence, and a timeframe is agreed in writing, prior to the conclusion of the contract by the customer; the customer shall not be entitled to cancel the order or to claim damages if the company is not able to deliver on the delivery date arranged.
3.2 Alterations to the order by the Customer may result in delay in delivery.
3.3 The Company will endeavour to comply with reasonable requests by the Customer for postponement of delivery but shall be under no obligation to do so and may charge the Customer with reasonable charges for storage during any postponement.
3.4 The Customer must ensure the provision to the Company of adequate access and necessary facilities to enable the Company to deliver/install the goods in accordance with the Customer's requirements.
3.5 The Customer will be required to sign a demonstration/delivery checklist on delivery/installation of the goods.
3.6 The Customer must ensure the delivery area is clear. On request the company may move existing furniture at the customer's liability to a different room in the same property. The company are unable to remove or dispose of customer's furniture or other waste.
4 Returns and Refunds
4.1 The Customer shall not be entitled to return the goods supplied for any reason other than in accordance with the Customer's statutory rights or under the guarantee conditions below. If Bluebell Mobility Ltd agree to a cancelled order or to return a bespoke order (you will be made aware if your order is a bespoke order' at the time of purchase), a reasonable handling charge of the value of the item may be charged. Items subject to hygiene issues e.g. bathing items, toileting items, bedroom accessories and cushions are not eligible to be returned is unsealed.
4.2 14 days cancellation rights are not applicable to any unsealed items subject to hygiene issues e.g. bathing items, toileting items, bedroom accessories and cushions.
4.3 Any items purchased that are personalised or custom-made items, including stair lifts, chairs and scooters, are not eligible for a refund due to costs the company has incurred. If you have changed your mind about a personalised or custom-made item the sooner you get in touch the more likely the company will be able to reduce any incurred costs.
5 Dimensions and Technical Data
5.1 All figures, speeds, measurements, capacities and other technical information and data contained in the Company's advertising, sales and technical literature are provided from the manufacturers for general guidance only. Product performance can be greatly affected by individual use cases.
6 Guarantees
6.1 The customer’s statutory rights are not affected by any conditions in this document.
6.2 The product you have purchased may come a guarantee from the original manufacturer. This guarantee covers the cost of replacement parts and labour for any fault caused by manufacture or installation. The product may be repaired or replaced (like for like), unless either option is impossible or disproportionate to the other. All guarantees do not include abuse or misuse or error on the customer’s part, or failure to properly follow the instructions in the Owner's Manual.
6.3 In the event of a manufacturing defect in the goods supplied becoming apparent within twelve months of the delivery date the Company either itself or by an authorised dealer/repair agent will affect any necessary repair or replacement of parts free of charge on condition that the Customer complies with the provisions of this guarantee. In some circumstances the manufacturer will require the goods to be returned to their premises for examination to establish if guarantee is applicable. The company has no obligation to provide customers with loan equipment during this time.
6.4 Any part repaired or replaced during the 12-month guarantee period is guaranteed for the duration of that period.
6.5 The arrangements for repairs and service and the designated repairer will be notified to the Customer by the Company and will be confirmed at any time on request
6.6 On a manufacturing defect occurring during the guarantee period the customer must notify the company at the first opportunity giving full information as to the problem and no use must be made of the goods and no alteration or unauthorised repairs made to the goods prior to inspection by the company.
6.7 The company reserve the right to appoint an alternate authorised repairer at our discretion.
6.8 Items of a consumable nature will not normally be covered during the 12-month guarantee period unless such items have suffered undue wear as a direct result of an original manufacturing defect. These items include amongst others lubricant, motor brushes, upholstery, tyres, inner tubes, brakes and similar parts. Batteries will be covered by the guarantee only where they have been charged and maintained fully in accordance with the manufacturer's recommendations.
6.9 Under normal circumstances, no responsibility will be accepted where the goods have required repair or replacement as a direct result of:
· The goods or part not having been maintained in accordance with the manufacturer's recommendations and not using the specified original equipment parts only.
· The goods or part having been damaged by neglect, accident or improper use.
· The goods or part having been altered from the manufacturer's specifications, or repairs having been attempted prior to the designated repairer being notified.
· Fair wear and tear.
6.10 Please note all products to be repaired under guarantee that were collected from store, need to be brought back to your nearest store for Bluebell Mobility Ltd to action the guarantee. Products that were delivered and need to be repaired under guarantee may be collected by Bluebell Mobility Ltd or repaired on site as long as the customer remains within the company's delivery radius, outside of this radius additional costs will be borne by the customer.
6.11 Guarantees/warranties are provided by the original supplier of the goods and not by Bluebell Mobility Ltd directly.
7 Complaints
7.1 If you are not happy with the service you received from Bluebell Mobility Ltd, in the first instance you should contact your local store. If they cannot resolve your complaint to your satisfaction and you wish to raise the issue with Head Office you can do so by, email to contact@BluebellMobility.co.uk or by writing to: Bluebell Mobility, 38 Unicorn Way, Kingdom Shopping Centre, Glenrothes, KY7 5NU.
8 Force Majeure
8.1 Neither party shall be under any liability for any delay, loss or damage caused wholly or part by act of God, governmental restriction condition or control or by reason of any act done or not done pursuant to a trade dispute whether such dispute involves its employees or not by reason of any other act, matter or thing beyond its reasonable control, including failure by the other party to carry out the provisions of these Conditions.
